CFTC Proposes New Crypto Guidance Following Senate Bill Rejection

The U.S. Commodity Futures Trading Commission (CFTC) has submitted a two-part, confidential proposal for cryptocurrency regulation to the White House Office of Information and Regulatory Affairs (OIRA). The filing, identified by RIN 3038-AF80, aims to establish oversight for crypto asset markets and their underlying transactions.

Confidential Review Process Underway

While the specific details of the proposal are currently under wraps as it undergoes initial White House review, the outline suggests the potential creation of a new category of exchange termed “crypto asset markets.” This would enable both existing and prospective cryptocurrency exchanges to conduct spot trading of digital commodities, including Bitcoin (BTC) and XRP, under the CFTC’s supervision.

OIRA has a maximum of 99 days to complete its review. Following this, the proposal will return to the Commission for a vote before being published in the Federal Register. Subsequently, it will be subject to two separate 60-day public comment periods. Industry observers anticipate that a final, binding rule is unlikely to be implemented before late 2027.

Broader Regulatory Push in the Crypto Space

This development is part of a series of actions by both the CFTC and the U.S. Securities and Exchange Commission (SEC) aimed at shaping the cryptocurrency ecosystem, particularly in the wake of the recent rejection of the CLARITY Act in the Senate.

Just yesterday, the CFTC announced an exemption for crypto and prediction market software providers from broker classification under specific conditions. Concurrently, the SEC introduced a five-year “Innovation Exemption” rule, which allows for on-chain trading of certain tokenized stocks.

Bitcoin Defies Bearish Market Sentiment

Despite a backdrop of potentially bearish market indicators, including anticipated Federal Reserve interest rate hikes, Japan’s potential shift to dovish rates, a rise in the U.S. Dollar Index (DXY) above 100, and oil prices exceeding $100 per barrel, Bitcoin has demonstrated resilience. The cryptocurrency has surged past the $80,000 mark, decoupling from these negative narratives. The broader cryptocurrency market capitalization has also seen a significant increase, rising 5.11% on the day to $2.76 trillion.
